If my H1 transfer is approved on say 1st August 2010, do I need to join the new company immediatly say 2nd or 3rd or can i take some more time say 2-3 weeks (Aug 20th) to join?

Hi,
is it absolutely safe to travel with pending i 485 app with valid h1b stamping with receipt notice and completed fp.?we are kind of confuded whether to plan for the travel...We have not yet received the actual advance parole. i read somwhere that if u leave the country wth pending i 485 but without ap ur appl is considered abandoned.is this true.?..we have the option to change the trip to apr too.In a nutshell is it completely safe to travel on 485 pending appl without ap with valid stamping.?:confused:
Has any1 wth the same situation has gone and come back without any issues?

Whats your PD? If you are on H1, have a stamping and already have the 485 receipt, the only possible issue with travel is if your 485 gets approved when you are abroad. People have still managed to enter on H1 as PoE officer apparently does not realize about your 485 approval.
If its a recent PD, then no issues, you can travel (Actually my lawyer told me I can travel even without getting the 485 receipt, but thats apparently a bit of a grey area)

I know we are pouring our ideas in different threads including one who supports our cause like name/news of senators/rep with grades, companies (employers), univ, associations, news reporters, talk show host, media, etc.
So I thought of creating this thread just to compile list of one who support the bill (or) one who we can convince our cause to support us, etc. This will definetly help the IV core team.
I know IV core team is aware of (or working with) most of the supporters, but still each new addition counts to our success.
for e.g., I read an article few days ago "1986 bill authors make a final push" in IV news article thread (http://www.washingtonpost.com/wp-dyn/content/article/2006/09/14/AR2006091401179.html) which talks about the opinion of "1986 Immigration Reform and Control Act - IRCA, or the Simpson-Mazzoli bill" authors Romano L. Mazzoli (was a Democratic representative from Kentucky) and Alan K. Simpson (was a Republican senator from Wyoming.)
after reading this, today I thought, might be an idea to contact these former senators, who can voice our genuine legal immigration concerns. Definitely they will have friends in capitol hill on both parties who will listen to them and also people are talking more often about them now than ever. this will help us in great deal. IV core team: please contact these former senators and pitch for the immigration reforms.
so please come up with the list of people or organisation, etc....whom you can think will help our cause in this thread.

The only answer to your question is:"it depends". Who are your state's Senators and how interested/influential are they in immigration issues? Same question for whoever is the Congressperson for your district. I don't think any there is any harm in contacting both Senators as well as the Congressperson for your district.

I140 pending under EB3, non premium category with receipt date 2/1/07.
I have worked for my current company for 6 years. Currently in the 7th year of H-1B with 1 year extension until March 08.
I want to change jobs due to dissatisfaction with current work, and also due to possible future restructuring within company.
How can I change companies without having to go back or live overseas for 1 year and start the process all over again?

I am in the same situation.. send docs to Dallas lockbox.
Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.
Do let me know when your checks are cased.

Mine is approved I140. If USCIS doesn't ask for paystub then giving EVL of any consulting firm will solve the problem?
Also, my wife is working on EAD. Can she apply for H1 visa? Will it affect our GC process? I am the primary applicant.
A bonafide job offer is what is needed. You may want to contact lawyer personally and they will be able to guide you in this.

In that update they answer the employer point of contact questions that is often asked by employers. My wife did her MBA and used her OPT before marriage. After a gap of OPT period she again went to school and got a MS degree. During her OPT, she did not work at all. Now she is unable to get second OPT for her recent MS degree.
Is there a way out to get second OPT? Can this new law (29 months OPT) if passed, be used to apply for second OPT.
What should be best approach? Please advice.

A student can get an OPT once for every level of education. Since your wife already had an OPT at the "master's" level (it does not matter whether she could earn money during that period or not), she can only get another if she goes for a Ph.D. After completing the Ph.D., she will get one more OPT.

There are two phases to this fight. The first phase has less to do with us and more to do with waiting for the dust to settle. We have to wait till the end of the elections for getting a clear perspective of what our approach should be. It looks like the lame duck session will be short and we will be very lucky to have anything done.
The second phase is to start contacting congress men after the elections and push the momentum to have something passed.
In the meantime we have to keep creating more awareness among people about this problem. It requires patience and you have to keep frustration and negativity out. As you can see there are plenty of people who are ready to spew negativity at the slightest provocation. The way I see it, we do not have an option to fall to negative sentiments. We have to fight this out no matter what the odds.
