my wife has filed for her I-485 (AOS) with me.
She has an H1 whch expires in 2012.
she used her AP while entering US this year at port of entry. Office gave I-94 for one year(it expires in Jan 2011).
Now my question is does she has to do anything to renew her I-94?
If she doesnt renew her H-1 now will she be still in-status on H1?
does she have to renew her AP in order to stay in status?
This area of the law is very confusing and it would be great if some attorney or expert give their valuable suggestions on this.

I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.

You can send both in one envelope But write separate checks for each one. (Remember attrorney send entire set of I-485+I765+I131 for each family member in same envelope).

Company A can not by law press any charges for the filing fees of H1B petition but they might go after you to pay for other costs in case you have agreed to pay for attorney fees.

My confusion is, as soon as I enter on AP I am on EAD and I don't have approved EAD. Does this mean I can not work untill I get EAD approved? I don't have Visa Stamped and I am not planning for Visa Stamping.
you can still continue on H1B (same employer) as long it is validity..even when you use AP at POE..

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

Hello,
Last week i received RFE for my wife's father's name. The name on birth certificate is different from school leaving & other docs. I'm trying to get it corrected from Mumbai.
I beleive if i get a correct one matching with other docs, i should be ok.
Another issue, i have is i have rented an apartment under my name close to my work in the same state. All my docs have my home address, my question is will it affect my case if they find another address under my name?? I still have official address as my home everywhere...
Yes you need to make sure that all documents have consistency in names and dates. As far as your second question goes USCIS has space for just one address which should be your current address. So as long as you can prove that the address listed in CIS system is the most current address then you are fine. There is no law or no way to provide multiple address. Just make sure you can prove that address on file is your primary residence.

If your stay is less than 1 year abroad, you can reenter using just your green card. If you want to stay 1-2 years outside the U.S, you will have to apply for a reentry permit before departure. But, it will be considered as a break (i.e, more than 1 year abroad) in the continous residence requirement of 5 years when it comes to your naturalization application.
If you want to stay longer than that, you will have to apply for "returning resident permit" for which you need to prove that your intent is to be a permanent resident but, your stay abroad longer than the period of the reentry permit was beyond your control.
Please consult an attorney so that you don't lose your PR.

My mother-in-law would like to get visitor visa.
How do I answer #37 of the DS-156?
The applicant's (my mother-in-law) son( my husband) is in the U.S. illegally. I am US cit. and my husband needs to report to visa interview within the next year. We have been post-poning due to medical issues. In the meanwhile we hope my mother-in-law can come here to visit her granddaughter.( I am unable to travel). #37 of the DS-156 asks if any body is in US. We should answer YES, because her son is here, BUT, what do we put for his status? Illegal? I read one article that stated to mark YES only if he has legal status. I do not want to put NO, immigration already knows he is here and we do not want to be dishonest.
Any ideas?

I am new to IV. I am just wondering whether we have ever emphasized on bifurcation of Immigration Bill or call for a interim law to facilitate legal immigrant's issues ( mainly retro victims) -
Our problems are very basic and do not have sociopolitical or economical strings attached to it (Probably works better for economy as lot of us are holding on to buy houses and other big budget stuff).
The main issue I have is
- Unable to change jobs
I can wait for GC but not being able to change jobs is hurting me most.
Employers do not find projects and do not pay on bench. Once you find a project Employer wants a big cut. All in the name of policy ;) .
Please share your thoughts.

My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?
