One of the questions on I-140 RFE goes like this:
"Submit evidence that the alien obtained the required two(2) years of programmer analyst experience in the job offered before the priority date was established on June 26, 2006. Evidence ...."
In reality the labor was filled for this EB3 I-140 in August 2003. This is not a substitution. I dont understand what they mean by "establised on June 26, 2006"? Can someone interpret this?

Thing is inspite of these recommendations they reverted the July bulletin with no notice period to public. Not sure why they recommend and have the office Of Ombudsman if USCIS does not implement their recommendation?

My original L1B visa was from Mar2004 to Mar2009 ( 5 years)
In Aug 2008 I left my L1 sponsor and started working on EAD for different employer( used AC21 portability)
Now my question is can my employer apply for H1B visa for me in April 2010?

As Silverlight is a browser side technology, you would have no problem serving Silverlight content from our servers as long as you add the proper MIME type settings to the site via .htaccess rules such as:
AddType application/xaml+xml .xaml
AddType application/x-silverlight-app .xap
AddType application/x-ms-xbap .xbap
HTTP responses have a "content-type" as apart of their header.

Examples are JPG, HTML, EXE.
It is advised to set the content type appropriately when you serve a file from your webserver by modiftying your htaccess file. To be honest, you can get away without setting this for all the popular browsers from my experience, but it might affect caching or obscure browsers negatively. There could be other implications, but none that I'm aware of.

AFter FP, the LUD is because, during FP, they pull up the records or update the record with your Photo and signatures etc.
Name check is initiated after Notice is generated on ND. So it is seperate from FP.
FP response, not sure what happens when it comes back.

You will apply at the local SSA (Social Security Administration) office and not at USCIS. Your card will be mailed to you within 15 days in most states.
Please forgive my ignorance Gurus but I want to know when EAD is approved, how would one receive a SSN? Does that need to applied separately at the local USCIS office? If yes, then as per my understanding this would mean a further delay before one can start work, since it takes time to receive a SSN.
Correct me if I am wrong.
I am referring a common scenario for all H4 visa holders who do not have a SSN.
Please share some knowledge on this.

As it sound to me It means PD of primary applicant will be the PD of spouse and child.
I did not follow.
Anyway this is the situation. I'm in EB3 with a PD Dec 2002. DH is in EB2 with a PD in 2006. Can he file I-485 for us using my PD according to the above law?

I plan to go on vacation in Dec to Peru.
I also need to get my h1 stamped.
Has anyone stamped from Peru or some South American country?
Can you let me know if any issues.
The embassy has a number that gives access to a service where I can schedule an appointment .. but does not allow me to speak to anyone.
My understanding is that you can apply for H1B stamping only in Canada, Mexico, your country of residence or your home country. If your home country is not Peru or your country of residence is not Peru, you cannot apply for H1B stamping in Peru. I tried to do something similar and wanted to get my H1B stamped in Germany - but my lawyer told me that I could not do that.

Few months ago, my company filed for my 7th year extension and USCIS approved the extension for only 8 months instead of 1 year (my I-140 hadn't been approved yet). My lawyers contacted USCIS for clarification and we finally heard back from them. They say that the approval of 8 months is correct and gave no explanation for why it was not for 1 year (which I would have qualified for since my LC was approved when the extension was filed).
Has anyone else experienced a similar thing?
Check with you employer on the validiity of the associated LCA. At the time of your H1 approval, there might have been only 8 months of validity left on the LCA. Other reason could be, assuming you are working for a consulting company, USCIS might have given you an extension till the end of the current project. I have seen several cases where USCIS only gave 6 month extensions because the project PO was only valid for 6 months.
Has anyone else experienced a similar thing?

I have a friend in India who applied to a new H1B through a consultant, was lucky to get through the lottery but is now stuck in RFE because of issues with the consultant. He heard from someone else that the same consultant is getting rejects and is nervous that his case will get rejected too.
I've heard that while a H1B case is pending (before it is denied), one can apply a separate petition from another employer and is still considered a valid application that is within the quota as it is for the same applicant.
Does anyone have experience in this area? What do you recommend? I also plan to contact an attorney regarding this to help my friend.
