Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.
So your answer should be. "I need H1B sponsorship to work."

Here is my understanding --
If the sister company uses a different Fed Tax ID (i.e. is an independent company legally), they can file your GC in EB2 using your experience in previous company.
I did not face this situation but somewhat similar. Our company was acquired by another holding company but we are maintaining our Tax ID. The Attorney said that my H1 as well as GC process remains valid since we are being treated as a independent company legally.

Wait time for spouse to get a green card as a derivative from you would be apporximately 5 years since you already have your green card now. the best option is to wait for to get your US citizenship and them apply for your spouse and in that case the max. wait time os only 3-6 months. Hoep this helps.

Silicon Valley Immigration Lawyer Blog Has Just Posted the Following:
Former Secretary of State and advisor to two presidents, Condoleezza Rice, addressed the San Jose Silicon Valley Chamber of Commerce earlier this week at their annual fundraiser. She warned about the need for immigration reform (http://www.mercurynews.com/breaking-news/ci_13717697), explaining "The United States of America had better reform its immigration policy to make sure that the most ambitious people in the world still want to be a part of us. We are a society of immigrants, and if we ever think that we can close our doors, we will suffer the same fate of those in Europe and other places."
As an immigration lawyer, I have posted before about the need for our immigration laws (http://www.siliconvalleyimmigrationlawyer.com/2009/10/immigration-laws-must-allow-th.html)to encourage the world's best and brightest to come and stay in the U.S. As for Europe, many European countries have far stricter immigration laws than the U.S. While I don't know what the sorry "fate" is that Former Secretary of State Rice was alluding to in her address, stricter immigration laws are not the answer to raising the U.S. out of its current economic downturn and high unemployment.

Hello everybody,
My wife who is on H4 was denied admission to a masters in accounting program due to lack of work experience. Other factors (GPA/GMAT scores) were allright according to a professor at the university! Does anybody know how/where she can get some experience (voluntary/unpaid/intership). We have already looked at craigslist job listing in the non-profit sector and not many people are looking to hire even if its unpaid:eek: We reside in Raleigh/NC and was wondering if someone in this forum has some insight as to how we can move forward.
Skark
Please understand that by law they can hire you ONLY if a position presumes volunteer work. If there are other similar positions that ARE PAID, you are out of luck.
My wife is a chemist. That's even worse.
Best wishes!

Hi,
I am unable to determine if the 180 day timeline is calculated from RD or ND? There are different opinions here in this forum and no clear answer. Is there a law text that defines this clearly...does anybody know?
yea...I did search this and some of the other forums

Can forum members help me with the following query. If you see the same question has been asked by other members as well.
Can you look at the LUD and say that your Name Check is clear or not?
This is what is goig on. Withing 1-2 days of your Biometrics the LUD changes. This is I guess that your biometrics were recieved by USCIS or sent for Name check or whatever. Then there is a LUD change in a week. Is this the reply from FBI saying that no record found? I mean everything is ok?
I ahve seen people who are stuck did not get the email after a week. Is this the right assesment?
http://www.fbi.gov/page2/nationalnamecheck.htm
The majority of name checks submitted on a data tape are electronically checked and returned to the submitting agency as having "No Record" within 48-72 hours. A "No Record" indicates that the FBI's UNI database contains no identifiable information regarding a particular individual. Duplicate submissions (i.e., identically spelled names with identical dates of birth submitted within the last 120 days) are not checked, and the duplicate findings are returned immediately to the submitting agency
Thanks in advance,
akela

I would like to take a quick poll to find number of people who have filed their 485 when they were single and got married later.
The idea is to get a rough number or percentage of people stuck in this boat in the IV community. This would help to start a proposal for a small fix (either admin or legislative) to be passed on to be included as an item in IV's agenda. Believe there are many families stuck in the EB2 of retrogressed countries and many more in all of Eb3 categories who can benefit from a such an initiative.
Here are the options in the Poll:
1. Married; I-485 Filed for everyone in the family at the same time.
2. Married; I-485 filed separately for spouse/ dependent at a later date.
3. Married; yet to file I-485 for spouse/ dependent.
4. Single; yet to get married but filed for 485.

Hi,
I am trying to fill the G325 Application. I have one field left to fill Alien Registration Number. Is this the I-94 number or any other number on the Visa or any other document?
I would really appreciate your help!

How long does it take these days to process greencard in L1 Category these days. If the sponsor company applies L1 visa for a very experience worker, what is the best type of L1 visa needs to be applied that will lead to a quicker greencard status.

I don't intend to get anyone's hopes high as I am not sure if this page on the USCIS website is an updated one or is an older one, but it says PP is available for 129 & 140.

Yes. I did contacted both Kerry and Brown's office last month (July end) for my EAD renewal application.
Both office staff were very receptive. Brown office has more than one person working on immigration matter....and I believe they were first to act on my case. I got EAD approval 4 days later.
