Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

ISO is the one which updates the SEVIS database. Since you claim its their mistake, you should approach them for advise on this as well. I have heard that voluntary work (no pay) in your field of study can help you to maintain your status and not count days towards the 90 day unemployment rule. If true, you can pursue that option as well till your job starts on Sep 1.

Does USCIS usually says this. i assume it should say "AP approved " or something similar. Have anyone seen this message on tracking your online case status.

I also asked my company lawyer and they are suggesting that since her status is H4 she can not work. For working on EAD she has to leave country and reenter on AP.
So a little confused here?

Pls. google USCIS pages for official info. You cannot stay for more than 6 months away from US each year every year. The situation might be different if its a US based company abroad.

I have 3 months left in my 6th year of H1B. LC and I-140 got approved and presently my employer has filed for an extension of H1B for 3 years.
Once I get the 3-year extension, can I change jobs? I understand that my GC process resets, and I am ok with that. I am planning to get the H1B (valid for another 3 years) transferred to the new employer and would join them only after they get the I-797 (with 3 year validity)
If my present employer revokes I-140, can I legally stay in the country on the 3-yr H1B (new employer)? Or do I lose my status and have to immediately exit the country? I am not worried about retaining my PD.
Could you pls share your experiences in this and I would request suggestion on this. Request your help.

I am new to this forum. My husband is working for a desi consulting company and they also filed for my h1. Now my hubby is planning to move out.
When my hubby moves out they might bargain using my h1 approval.
They havent given me a copy of the H1b approval. Could some one tell me the reasons to get the I-797 copy from the consultant?Once I get it I would like to transfer to some good company.
I heard that there is a I-824 form requesting copy when the actual approval notice is lost. Can I file for that and it seems it takes 6 months to get the actual copy.
Does the info pass help here ?

Honestly, if the Democrats lose this seat, it is because of taking their voter base for granted.
Hopefully, this will light a fire under them and make them more focused on their promises.
I agree that if they lose this seat, it will be the end of CIS and it will be hard to pass any meaningful legislation for us either.

On paper, the D2X looks really great and certainly meets my expectations. Only time and testing will tell and I'll wait for the verdict to come in before I buy one. However, I'll be saving my pennies in anticipation that this camera will perform well. Nikon has not released any price information to their dealers but one told me to expect this puppy to be in the $4000 - $5000 price range.
If this is as good as it looks perhaps Nikon users will be in the same boat as Canon users when it comes to finding new and used lenses. Now might be the time to pick up some good "surplus" Nikkor lenses that are all over the place.
I see that the D2X will be using a CMOS sensor instead of a CCD. As a relative neophyte to digital photography I'm curious as to why they did this.
Anyway, these are exciting times and this is exciting news. Hopefully the D2X will be a superb performer and I'll only have to buy the body instead of changing brands and having to buy everything all over again.

I have an urgent case regarding the I-485 initial evidence. I sent out my I-485 application w/ I-864 and I-864A back in November, 2009. I am a F-1 visa holder currently in PhD program with around 21,000 stipend per year. My wife which is the petitioner (I-864) has no income and she filed a I-864 with my stipend in the first I-864 form. Since I am the beneficial and the instruction said that I didn't have to include my W-2 form. My parents in law had a joint account together. My father in law filed another I-864 form with his stipend of 20,000, and my mother in law filed a I-864A form with her stipend of 20,000. They have joint tax returns, and I have given immigration the copy of their 3 years W-2 and 1040 form.
A few days ago, immigration has send me request for initial evidence (I485) with the check marks says
1. The household member on the petitioner/sponsor's form I -864, must submit the federal income tax return submitted to the IRS for the most recent tax year.
2. The household member on the petitioner/sponsors form I-864, and I-864A must submit all supporting tax documentation (W-2s) submitted to the IRS for the most recent tax year.

PD has to be current for the I485 to be accepted. For a dependent's application, Primary's PD is used. Bottomline, you will have to wait till your PD becomes current to apply for your wife. Most likely, the application will be returned.

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

Can you please help me figure out how to calculate the eligibility for citizenship. If one married a US citizen. Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?
